
1. Contract
Hazel's Cottage offers short term self-catering holiday rentals. All confirmed bookings constitute a binding contract between the Owners of Hazel's Cottage (us) and the Guests (you). Please note that when you submit a booking via our online enquiry and reservation system you will receive an automatically generated booking summary by e-mail to the e-mail address you provided in the booking form. This does not form a contract between us. A contract shall only arise when your deposit payment has cleared and you receive a written Booking Confirmation letter from us via post or e-mail.
2. Weekly Rates & Short Breaks
Self-catering rates vary according to season and are based on a weekly rental from Saturday to Saturday. Short breaks are available for a minimum stay of 3 nights and can be booked throughout the year except during peak periods. Rates are subject to change without notice although confirmed reservations will remain at the quoted rate.
3. Booking Procedure
Please contact us either by phone, e-mail or via our online enquiry and reservation system to check availability and make a provisional booking. All bookings will be deemed provisional until the completed booking form is received together with a deposit or full balance (depending on when the booking was made). Once payment has cleared a written Booking Confirmation letter will be sent to you either by post or by e-mail containing details of your booking and any balance due. Upon receipt of the Booking Confirmation letter please check all the details carefully and notify us immediately if anything is incorrect.
Please note that provisional telephone or e-mail bookings will be held for 7 days awaiting your completed booking form and deposit or full payment. If the completed booking form and monies payable are not received within the 7 day period, we reserve the right to re-let the booking date.
Due balances must be payable 42 days (6 weeks) prior to your arrival. No reminders will be sent. If your balance is not received within the specified time frame we reserve the right to re-let the Cottage without further notice to you. In this case your deposit will be forfeited.
4. Deposit
Please note that all deposits and monies paid are non-refundable unless the chosen dates are unavailable in which case all payments will be returned at once.
Weekly bookings more than 42 days (6 weeks) before the start of the rental period:
A deposit of 25% (twenty five percent) of the total rental fee is payable if the booking is made more than 42 days (6 weeks) before the start of the rental period. The balance is payable 42 days (6 weeks) before commencement of the rental. Non payment of the balance of the rental on or before the due date shall be construed as a cancellation of the contract by you and your deposit will be forfeited.
Weekly bookings less than 42 days (6 weeks) before the start of the rental period:
If a booking is made less than 42 days (6 weeks) before the start of the rental period the total fee of the rental is payable immediately upon booking. No cheques can be accepted for bookings made less than 14 days (2 weeks) before the start of the rental period.
Short Breaks
Short breaks (when available) must be paid in full at the time of booking.
5. Good Housekeeping Refundable Deposit
Guests are legally bound to reimburse the owners of Hazel's Cottage for any replacement, repair or extra cleaning costs that are required should the property not be left in the same good standard of condition and cleanliness as at the commencement of the rental period. A refundable deposit of £100.00 (one hundred pounds) must be paid with the balance due for these eventualities. The deposit (less any charges for breakages or extra cleaning costs) will be refunded within 7 days after the end of the rental period.
6. Payment
All payments must be made in Pounds Sterling. Payments can be made by either bank guaranteed cheque, debit card or credit card. All major credit cards are accepted. Cheque payments should be made payable to Dalnaspidal Guest House and addressed to Dalnaspidal Guest House, Tangy, Kilkenzie, Argyll, PA28 6QD.
7. Cancellation
Any cancellation made by you for whatever reason shall be made immediately by telephone and then confirmed in writing via Recorded Delivery to Dalnaspidal Guest House at the address mentioned above.
On receipt of the Cancellation Notice, we will endeavour to re-let the property for the period of rental. If the Cottage is re-let for the whole period we shall refund all monies paid less an administrative fee of £15 per booking. If we only succeed in re-letting the Cottage for part of the period booked, then an amount equal to the money paid less the rental for the period which is not re-let and an administrative fee of £15 will be paid. If we are unable to re-let the Cottage at all then all monies paid by Guests shall be forfeited to the Owners of Hazel’s Cottage.
As this is a legally binding contract, we strongly recommend that you obtain personal travel insurance to avoid disappointment should your holiday plans change in any way and you need to cancel or curtail your booking.
8. Change Of Date
We may consider requests from Guests to change the dates of their booking after a Booking Confirmation has been issued. Agreement will be given subject to all of the following conditions being met: (a) that we agree to the change (b) that the request is received more than 42 days (6 weeks) away from the start of the original booking period (3) Guests pay an administrative fee of £15 plus any increase in charge for a higher rate week where applicable.
9. Non-Arrivals
Guests who have booked but fail to arrive (or arrive but do not stay or do not stay for the full duration of the booking) are liable for the full cost of the booking unless we are able to re-let the Cottage for the period of non-occupancy.
10. Arrivals, Late Arrivals and Departures
Rentals commence, unless otherwise notified, at 4:00pm on the day of arrival and terminate at 10:00am on the day of departure. If you will be arriving after 6:00pm please notify us so that suitable arrangements can be made. If you fail to do so you may not be able to gain access to the Cottage. Please note that the approximate driving time from Glasgow is 3 hours.
11. Maximum Number of Occupants
Hazel's Cottage sleeps 4 people. Unless prior permission has been obtained at the time of booking, the number of Guests occupying the Cottage (including infants) must not exceed the number for which beds are provided (namely 4) and the composition of the rental party cannot significantly change during the rental period. Please note that we do not supply cots, bedding for cots or high chairs for infants. You are, however, welcome to bring your own.
12. Use and Care of the Property
Hazel’s Cottage has been lovingly restored and we ask that you treat the Cottage with the tender loving care and respect that it deserves. The Cottage can only be used for personal and domestic purposes and cannot be used by any member of your rental party for any commercial purpose, including without limitation, assigning or subletting the Cottage or otherwise allowing anyone to occupy the Cottage who has not previously been accepted by us. In making a booking all members of your rental party agree to keep the furniture, pictures, utensils, equipment and fixtures and fittings in the same good standard of condition and cleanliness as at the commencement of your stay.
Upon arrival we ask that you take a moment to check that everything in the Cottage is in working order and that the Cottage is to your satisfaction. Please notify us immediately of any faults or broken items. If at any time during your stay you discover any problems or faults please notify us immediately so that we can rectify the problems as soon as possible. In the event of you or any member of your rental party’s behaviour being unacceptable, we reserve the right to serve an immediate eviction notice on the entire party which will be treated as a cancellation by you. No refund of any monies you have paid in respect of your booking will be made and we will not have any liability to you whatsoever as a result of this situation arising.
13. Pets
For the comfort of all our future guests we do not allow pets in Hazels Cottage.
14. Smoking Policy
Please note that smoking is not permitted anywhere inside the Cottage. You are welcome to smoke outside ... but please use the bins provided and do not throw your cigarette butts in the garden. We reserve the right to serve an immediate eviction notice on the entire party which will be treated as a cancellation by you should the non-smoking policy not be adhered to. No refund of any monies you have paid in respect of your booking will be made and we will not have any liability to you whatsoever as a result of this situation arising.
15. Unsuitable Hirers
All bookings are received at our discretion and we have the right to refuse a booking or refuse to hand over holiday accommodation to any person who in our opinion is unsuitable to take charge. In such cases we will refund Guests all monies paid by them for the booking. No additional compensation, expenses, costs or other sums of any description will be payable by us.
16. Right of Entry
The Owners of Hazel’s Cottage (including workmen) shall be allowed the right of entry to the Cottage at all reasonable times during Guests occupation for purposes of inspection or to carry out any necessary repairs or maintenance. In the event of an emergency or where a problem needs to be remedied immediately and Guests cannot be contacted in time, we are entitled to enter the property at any time without giving you prior notice.
17. Adult Supervision
Guests agree to ensure that all children under the age of 16 (sixteen) years of age are supervised by an adult at all times during the duration of the rental period.
18. Linen and Towels and Cleaning Equipment
Pillows, duvets, bed linen and one set of bath towels per person are provided free of charge. We ask that you please bring your own beach towels and do not take our bath towels outside the Cottage. Tea towels and cleaning equipment is also provided. Additional bed linen and towels can be supplied at an extra charge. A tumble dryer is also available for use at an extra charge.
19. Water, Heating and Electricity
Water is supplied from a natural spring and although we have an extensive filtration system in place, water may sometimes become discoloured after periods of heavy rainfall or drought. Even with slight discolouration, the water is perfectly safe to drink and fully complies with the Local Authority’s rigorous health and safety standards for drinking water.
Heating is by way of electric panel heaters in all rooms, a multi-fuel stove in the lounge and one oil filled portable electric radiator. All electricity is included in the rental. Wood and anthracite for the multi-fuel stove is supplied free of charge for the first night during the months of October to March. Additional wood and anthracite is available for purchase during the winter as well as summer months.
20. Special Requirements
Should you have any special requests, we will try our utmost to accommodate them but please give us sufficient notice at the time of booking.
21. Liability
The Owners of Hazel’s Cottage shall not be liable to Guests or third parties for any accident, damage, loss, injury, expense or inconvenience which may be suffered, incurred, arise out of or in any way be connected to the rental of the Cottage or use of the grounds.
22. Force Majeure
The Owners of Hazel’s Cottage shall not be liable for any changes, cancellations, effect on your holiday, loss or damage suffered by you for any failure by us to perform or properly perform our respective obligations to you due to any event or circumstances beyond our control such as fire, flood, exceptional weather conditions, war, riots, strikes, epidemics or destruction or damage to the property.
In appropriate cases such as where your booking needs to be cancelled prior to your departure we will refund all monies paid by you for the booking. No compensation, expenses, costs or other sums of any description will be payable by us.
23. Disclaimer
Whilst we have taken all reasonable steps to ensure that the information contained in our brochures, website, supplements and advertisements are correct, we reserve the right to alter, substitute or withdraw any service, facility or amenity without notice, if necessary.
